This information text has been prepared by Beşiktaş Kültür Merkezi A.Ş. ("BKM") in its capacity as data controller within the scope of the 10th article of the Personal Data Protection Law No. 6698 and the Notification on the Procedures and Principles to be Complied with in Fulfillment of the Notification Obligation.
We would like to inform you about the personal data collected by our company Beşiktaş Kültür Merkezi A.Ş. ("BKM") through the website www.maximumuniq.com.tr and in relation to the services and activities provided within the scope of various “events” such as films, series, theatre, shows, and performances.
Membership is not a requirement to benefit from this website or services or events of BKM. Therefore, membership is not presented as a service requirement. You can benefit from our services without becoming a member.
The “Newsletter” membership option on BKM's www.maximumuniq.com.tr site is designed for users who want to receive a personalized service unique to themselves and be informed about BKM events. For offering these personalized advantages, some of your personal data need to be processed for the purposes detailed below, shared with our professional business partners we have an agreement with, and recorded into our programs and/or systems provided by our suppliers we receive technological service from. This depends on your explicit consent, which you will declare specifically about the newsletter membership.
Also, your personal data that you shared with us or with intermediary service providers like other ticket sales channels during your participation in events will be used for the purposes below and will be kept for the period required by law (for example, 10 years in contractual relationships), and can also be shared proportionately for its purpose with relevant private and public institutions and organizations.
a. Personal Data and Collection Methods:
Your personal data is collected either through your consent by becoming a Newsletter member or indirectly when participating in our events through intermediary institutions under your approval due to legal obligation or necessity for the service to be provided to you, or through digital and/or printed forms. These data include your identification details (name, surname, date of birth, gender), contact details (phone number, email, or home/work addresses); and data collected during your use of our website (such as cookie records), transaction security data (IP Address Information, Website Entry/Exit Information, Connection Time/Duration like Traffic Data).
b. Processing Purposes and Legal Reason of Processed Personal Data:
Personal data you provide as a Newsletter member with explicit consent or directly or indirectly through intermediary institutions we receive service from during your event participation; mainly for carrying out communication activities; creating special advertisements, promotions, and campaigns, determining target audience, tracking customer movements, carrying out activities to increase user experience, and developing BKM events and shaping them according to participant needs, carrying out direct and indirect marketing, personalized marketing, and remarketing activities, carrying out analysis and in-company reporting activities, carrying out market researches, planning, and execution of customer satisfaction activities and planning, and execution of customer relations management processes; can be processed for the purpose of planning and execution of sales and marketing processes of BKM's products and/or services in line with Article 5 of KVKK.
Your personal data is processed completely or partially automatically or non-automatically provided that it is part of the data recording system, under the legal reasons of your explicit consent, necessity for the service to be provided to you, and fulfilling our legal obligations.
c. Who Your Personal Data Can Be Shared With and For What Purpose
Your personal data may be shared with real and legal entities within the country (such as shareholders, our business partners, our suppliers, real or legal persons from whom we receive services, and authorized public institutions and organizations) for the purposes of providing products or services related to our commercial activity, fulfilling our legal obligations, and sending event information, campaign and promotion news, and commercial electronic messages within the scope of your consent.
However, in accordance with Article 28, "Exceptions" of the Personal Data Protection Law (PDPL), your personal data can be transferred to relevant authorities even without your explicit consent, if requested.
Your personal data will not be transferred to any person, institution or organization beyond our legal obligations and the purpose of collection.
Your personal data will not be transferred to any person, institution, or organization abroad without your explicit consent.
d. Your Rights Regarding Processed Personal Data:
Under Article 11 of the PDPL, you have the right to;
Learn whether your personal data is being processed,
Request information if your personal data has been processed,
Learn the purpose of processing your personal data and whether they are used appropriately,
Know the third parties to whom your personal data is transferred, domestically or abroad,
Request correction if your personal data is processed incompletely or incorrectly,
Request the deletion or destruction of your personal data within the framework of the conditions stipulated in PDPL legislation,
In case of correction of incomplete or incorrect data and deletion or destruction of your personal data, request that this situation be notified to third parties to whom your personal data is transferred,
Object to the emergence of a result against you by means of analysis of the processed data exclusively through automated systems, and
Demand compensation for the damage caused by the unlawful processing of your personal data.
